Privacy Policy.

LAST UPDATED: OCTOBER 19, 2026

This policy explains what personal information Functional Media collects through functional-media.com and our products, why we collect it, and the choices and rights you have.

01Who we are

The data controller is Functional Media, LLC, PO Box 144, Burlington, CO 80807, USA. Privacy contact: support@functional-media.com.

02What we collect

Information you give us

  • Purchases and memberships: name, email address and billing details. Card details are entered directly with our payment providers; we never see or store full card numbers.
  • Bookings: name, email and anything you write when you book a call.
  • Emails and messages you send us.
  • Newsletter sign-ups (when offered): your email address and, if provided, your name.
  • Marketing Lab members: the Practice Profile and questions you submit.

Information collected automatically

  • Strictly necessary: a first-party cookie (fm_consent) that remembers your cookie choice. Our host keeps standard server logs (IP address, browser, pages requested) for security and reliability.
  • Only with your consent: analytics and advertising data (pages viewed, approximate location, device and browser, how you arrived) through Google Analytics 4 and the Meta Pixel. See section 05.

Information we receive from others: our checkout and course providers (SamCart, Teachable) send us your order and membership details, and Cal.com sends us your booking details.

You can browse this site without giving us any personal information. If you buy a product or book a call, we need your name, email address and payment details to provide it; without them we can't complete your order or booking.

03Why we use it, and our legal basis

PurposeLegal basis (GDPR / LGPD)
Delivering products, memberships and bookings you request; account and support emailsPerformance of a contract
Billing, tax and accounting recordsLegal obligation
Site security, fraud prevention, server logsLegitimate interests (keeping the site safe and working)

Marketing emails (newsletter, offers)Your consent, which you can withdraw at any time with the unsubscribe link in every email
Answering your questionsLegitimate interests, or steps before a contract

04Who we share it with

We do not sell your personal information. We share it only with service providers who process it on our behalf:

  • Netlify, Inc. (US): website hosting
  • SamCart (US), with payments processed by Stripe and PayPal: checkout, payments, member access
  • Teachable (US): delivery of some course memberships and their payments
  • Google LLC (US): Google Workspace for email; Google Analytics 4 (with consent)
  • Meta Platforms, Inc. (US): Meta Pixel (with consent), and purchase information sent by our checkout provider to measure our advertising
  • Resend (US): delivery of newsletter, marketing and system emails
  • Cal.com, Inc.: call scheduling

We may also disclose information when required by law, or to protect our rights.

We don't make decisions about you based solely on automated processing (including profiling) that produce legal or similarly significant effects.

05Cookies and similar technologies

Cookies are small text files a website stores in your browser. Before you choose, the only cookie we set is fm_consent, which remembers your choice for 12 months.

If you click "Accept cookies":

  • Google Analytics 4 (_ga, _ga_*): helps us understand which pages people visit and how they found us. IP anonymization is enabled, and analytics data is kept for 14 months. Google's policy: policies.google.com/privacy
  • Meta Pixel (_fbp, _fbc): measures our Facebook and Instagram advertising and lets us show ads to people who have visited the site. Meta's policy: facebook.com/privacy/policy · Ad preferences: facebook.com/adpreferences

If you click "Decline", none of these load. You can change your mind at any time using the "Cookies" link in the footer. Choosing Decline later deletes the analytics and advertising cookies already set by our site.

You can also block or delete cookies in your browser settings; allaboutcookies.org explains how. Blocking strictly necessary cookies may stop parts of checkout from working.

Our fonts are served from our own website, so no font request goes to a third party.

On checkout pages, our payment provider (SamCart, Stripe or PayPal) may set cookies needed to process your payment securely. These are strictly necessary for the purchase you asked for.

06International transfers

We are a US company, our founder works from Brazil, and most of our providers are in the United States. Your information may therefore be processed in countries with data-protection laws different from yours. Where required, transfers rely on safeguards such as the European Commission's Standard Contractual Clauses, the EU–US Data Privacy Framework (for providers certified under it), or the equivalent mechanisms under Brazil's LGPD.

07How long we keep it

  • Purchase, billing and tax records: 7 years, as required by law
  • Membership and account data: for the life of your membership, then 2 years
  • Booking and support emails: 2 years after our last contact
  • Newsletter data: until you unsubscribe, then a suppression record so we don't email you again
  • Analytics data: 14 months
  • Cookie choice: 12 months

08Your rights

Depending on where you live (including under the GDPR, UK GDPR and Brazil's LGPD), you have the right to:

  • access the personal information we hold about you, and get a copy (portability)
  • correct inaccurate information
  • delete your information (subject to legal record-keeping)
  • object to, or ask us to restrict, certain processing
  • withdraw consent at any time, without affecting processing done before you withdrew
  • receive information about who we share data with
  • complain to a data-protection authority: in the EU, your local supervisory authority; in the UK, the ICO; in Brazil, the ANPD

To exercise any right, email support@functional-media.com. We'll respond within one month and may need to verify your identity, usually by replying from the email address you used with us.

09Marketing emails

We only send marketing emails if you've opted in. Every marketing email includes an unsubscribe link and our mailing address. Unsubscribing doesn't stop transactional emails about your purchases or membership.

10Security

We use reasonable technical and organizational safeguards, including HTTPS everywhere, security headers, two-factor authentication on our admin accounts, and payment processing handled by PCI-compliant providers. No method of transmission or storage is 100% secure.

11Children

Our site and products are for adult professionals and aren't directed to anyone under 18. We don't knowingly collect information from children.

12Other websites

Our site links to other websites, including our checkout, booking and social media pages. This policy applies only to functional-media.com, so please read the privacy policy of any other site you visit.

13Changes

We may update this policy. The "last updated" date shows the current version, and we'll post material changes on this page.
