These Terms of Use ("Terms") govern your use of functional-media.com and the purchase of Functional Media memberships, digital products and services. By using this site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the site.
Functional Media ("we," "us") is a marketing and media company serving health and wellness practitioners. Contact: support@functional-media.com.
Content Bank memberships bill on a recurring basis (monthly, or every 6 months, depending on the plan you choose) until cancelled. You can cancel anytime from your account or by contacting us; cancellation takes effect at the end of the current billing period, and you keep access through that period. There are no contracts and no cancellation fees.
Refunds: because membership content is delivered digitally and available immediately, membership payments are not refundable. You are never obligated beyond the billing period you are in.
Store products (vaults, booster packs, tools) are one-time purchases with instant digital access. Because of the immediate digital delivery, these purchases are not refundable. If you have a problem accessing a product you purchased, contact us and we will make it right.
When you purchase a membership or product, we grant you a non-exclusive, non-transferable license to use the content for the marketing of your own practice or business. You may customize, edit and publish the content under your own name and brand. You may not resell, redistribute, share, or provide the content to other businesses or practitioners, share login credentials, or use the content to build a competing product. One license covers one practice or business.
Some memberships and products come with their own additional terms and conditions, presented at checkout or inside the product itself. Those product-specific terms apply in addition to these Terms. If a product-specific term conflicts with these Terms, the product-specific term controls for that product.
All site content, product content, designs, templates and branding are owned by Functional Media or its licensors and protected by copyright. Purchasing a license to use content does not transfer ownership of it.
Our content and services are marketing materials and business education. They are not medical, legal, or financial advice. You are responsible for ensuring that anything you publish complies with the laws, regulations and professional rules that apply to your practice and jurisdiction. Client results shared on this site are real and member-reported; they are examples, not promises. Your results will depend on your effort, market and circumstances.
Testimonials on this site are from real members and clients. Some are shown with initials or roles at the member's request. They reflect individual experiences and are not guarantees of similar outcomes.
We use third-party services to run this business (hosting, payment processing, content delivery via Google Docs and Canva, email). Your use of those services is also subject to their terms. Functional Media is independent and not affiliated with or endorsed by Meta Platforms, Inc., Google, or Canva.
We may suspend or terminate access for violation of these Terms, including content-sharing or resale violations. Your license to use previously delivered content for your own practice survives termination unless the termination was for a license violation.
The site and all products are provided "as is." To the maximum extent permitted by law, Functional Media will not be liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
We may update these Terms from time to time. The "last updated" date above reflects the current version. Continued use of the site after changes means you accept the updated Terms.
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.
